Membership terms and conditions
Bristol24/7 CIC, registered in England under company number 08904329 at 7 Queen Square, Bristol BS1 4JE (B24/7) would like to provide an opportunity for our supporters to make a financial contribution to B24/7 and thereby help it in its mission to provide quality, independent journalism, inspire the local community, include everyone and help shape a better Bristol.
These Terms and Conditions govern the relationship between B24/7 and each member or contributor (member), including the terms on which contribution may be accepted, refused, or returned by B24/7. The staff of Better Business members (business members) may benefit from membership without making their own contribution. Contributions will be accepted in the form of a one-off payment or recurring monthly payments made directly to B24/7 as described in these Terms and Conditions.
- AGREEMENT
By making a contribution, a member agrees and acknowledges that:
- the contribution is provided to B24/7 as an irrevocable gift, subject to any exercise of the contributor’s right to receive a refund as described below and B24/7’s right to return any contribution at its discretion;
- The contribution will be used by B24/7 to support its operations including delivering social and environmental impact projects; and
- The contribution is made subject to these Terms and Conditions, which shall constitute a legally binding agreement between the contributor and B24/7 (the “Agreement”), entered into by each party in consideration of the other’s obligations under these Terms and Conditions.
- RECURRING CONTRIBUTION PAYMENTS
- You agree to pay your selected contribution amount on a rolling monthly basis. Your contribution will be deemed accepted when we provide you with written confirmation of acceptance. Your contract and membership will come into existence when we issue this confirmation notice.
- Recurring contribution amounts cannot be changed without cancellation or changing your membership level.
- You must provide us with complete and accurate payment information at the time you agree to pay a recurring monthly contribution. Payment for your recurring contribution can be made by PayPal, credit or debit card (including VISA, VISA debit, Maestro, Mastercard and American Express).
- Your payments will be taken on a monthly rolling basis and your recurring contribution will continue unless and until it is ended by either of us in accordance with the provisions of section 5 (Refunds and Cancellation of Contributions). Recurring payments are collected on the same day of the month. If the initial recurring payment falls on the 31st, PayPal eventually adjusts the billing cycle to the 1st of the month. If the initial recurring payment falls on the 29th or 30th, PayPal adjusts the billing cycle to the 1st of the month on the following February.
- CONDITIONS
- Contributions will be accepted from individuals as well as any other legal entities
- Members who are individuals must be aged 18 or over and UK residents. All other contributors must be incorporated, established and/or registered in the UK (as applicable)
- ADMINISTRATION OF CONTRIBUTIONS
- All contributions to B24/7 shall be made through the membership area on our website: my.bristol247.com, which sets out the levels of Contribution that are available to be made (as amended from time to time). Contributions will be accepted by B24/7 for the period during which membership is available.
- Contributions received by B24/7 will be deposited in one or more bank accounts in the name of B24/7 together with other B24/7 funds.
- From the moment the contribution is processed, B24/7 will be legally and beneficially entitled to the full amount of the contribution and the member has no entitlement to the return of a contribution in any circumstances other than as specified in these Terms and Conditions.
- Members may receive benefits including perks including free and discounted products and services from B24/7 and our partners (Benefits), however these will be granted at the discretion of B24/7 and/or the partner organisations. Individual perks will have their own binding terms and conditions which you will find in the individual perk within the perk section- https://my.bristol247.com/perks/.
- Contributions to B24/7 are not charitable donations under the law of England & Wales and, as far as B24/7 is aware, members shall not be entitled to any tax relief in respect of their contributions nor are any contributions eligible for “gift aid” either in the United Kingdom or in any other jurisdiction worldwide.
- Members shall have no rights to influence the editorial policy or output of B24/7.
- REFUNDS AND CANCELLATION OF CONTRIBUTIONS
- B24/7 reserves the right to refuse and return any contribution in its absolute discretion, including without limitation where it believes that accepting the contribution would conflict with the mission, values or interests of B24/7, and/or where, having regard to the source of the contribution or intentions of the contributor, B24/7 considers that to accept the contribution could damage the independence or reputation of B24/7 or adversely affect the relationship of B24/7 with other contributors or stakeholders.
- Members shall be entitled to receive a refund of their contribution for up to 14 days after receipt of payment by notifying B24/7 by email at [email protected]. Any requests for a refund of a contribution received by B24/7 following expiry of the 14 day period will be ineligible.
- Any refused and/or returned contributions shall be repaid into the account from which the contribution was made.
- Recurring contributions can be cancelled at any time, simply email [email protected] or call 0117 2309 247. Any future recurring payments will stop after cancellation email had been received. Any payments taken before that point will not be refunded. Lines are open Monday to Friday 9am-5pm.
- Cancellation requests will be confirmed within a maximum of 5 working days. No further payments will be taken from any membership or contribution account after we confirm cancellation.
- TRANSPARENCY OF CONTRIBUTIONS
- B24/7 reserves the right to:
- Request the full name and contact details of members;
- request from the member any other information that it considers to be necessary or desirable to determine the provenance of the contribution
- undertake any further investigations it deems fit to determine the provenance of the contribution
- If the contributor refuses to provide any information requested by B24/7 under this clause, B24/7 may refuse and return the contribution to the member at its discretion.
- DATA PROTECTION AND PRIVACY
- All members may receive information relating to offers from B24/7 via the email address supplied by the contributor. Members may unsubscribe at any time by clicking on a link at the bottom of all email correspondence or by contacting [email protected].
- Any personal information about a member obtained by B24/7 as a result of a contribution being made will be used in accordance with the B24/7 privacy policy, available at https://my.bristol247.com/privacy-policy/. By making a contribution, the contributor accepts the terms and conditions of the privacy policy.
- EXCLUSION OF LIABILITY
- Neither B24/7 nor any affiliated person, employee, agent, officer or director shall be liable for any loss suffered by any member or other person arising out of or in connection with a contribution, whether direct or indirect, including loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, any Benefit provided by B24/7 is presented “as is”, and B24/7 shall not be liable for any loss arising out of Benefits provided by third party Benefits providers.
- Nothing in these terms and conditions excludes limits or excludes any liability for death or personal injury, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.
- Subject to clause 9.2 B24/7’s total liability to you shall be limited to your total contributions made to date.
- BENEFIT REDEMPTION
- Any Benefits that you redeem through your membership are redeemable for the goods and/or services of a specific benefits provider. You acknowledge and accept that the Benefits provider, not B24/7, may in some cases be the provider of the goods and services and is solely responsible for providing any Benefits you wish to redeem.
- Benefits provided by the membership scheme may be offered to you either for free or significantly below their retail price and are subject to these terms and conditions and those of the participating Benefits provider.
- Where a concession is claimed, proof of identity and concession entitlement (for example of age or student status) may be required by the provider of the Benefits.
- B24/7 shall retain full and final control over which Benefits provider shall provide Benefits as part of the membership.
- These terms and conditions incorporate any additional terms and conditions set forth on the face of each of the Benefits. In the event of any conflict between these terms and and any terms and conditions set out in respect of each Benefit , these terms and conditions shall prevail.
- The Benefits provider is fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect you in respect of the Benefits, whether caused in whole or in part by the Benefits provider, as well as for any unclaimed property liability arising from unredeemed Benefits.
- Benefits are redeemable in their entirety only. They may not be redeemed incrementally.
- Reproduction, sale, transfer or trade of any of the Benefits is strictly prohibited. Should a member attempt any of the above activities, B24/7 retains the right to terminate the membership without recourse to any refund of membership fees paid by the member. Repeat offences may result in termination of a business membership also without recourse to any refund of membership fees paid by the business member.
- Any attempted redemption not consistent with these terms and conditions will render the Benefit null and void to the extent allowed by law.
- If you redeem the Benefit for less than its face value, you will not be entitled to a credit, cash or a new Benefit equal to the difference between the face value and the amount you redeemed, unless otherwise required by law.
- Benefits may be applied only to goods or services sold by the Benefits provider, and may exclude shipping or handling charges.
- Benefits may not be combined with any other gift certificates, third party certificates, benefits, or promotions, unless otherwise specified by Benefits provider.
- B24/7 does not provide any specialist advice (for example, advice for accounting, regulatory, legal, pensions or taxation matters) in relation to the Benefits, the membership, or member’s use thereof. Members shall be responsible for obtaining its own specialist advice where necessary and B24/7 accepts no liability in respect of such specialist advice.
- BENEFIT DELIVERY
- B24/7 will deliver the Benefits redeemed in one or in combination of the following methods:
- Through the online member’s area (website)- my.bristol247.com
- Email the Benefit as a unique voucher to the member’s email address provided at the time of claiming the Benefit on the B24/7 website.
- Benefits may have unique identification numbers or code and may require the Benefits provider to enter a four digit code on the member’s device to complete redemption of the perk. Authentication and uniqueness of the Benefits in such section will be based on the type of service being redeemed, and the Benefits provider’s preference.
- MISCELLANEOUS
- A failure of B24/7 to assert a right or provision under these Terms and Conditions shall not constitute a waiver of that right or provision.
- If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect.
- This Agreement constitutes the entire agreement between the contributor and B24/7 in respect of any contributions made by the contributor.
- These Terms and Conditions are not intended to confer any contractual benefit on any person pursuant to the terms of the Contracts (Rights of Third Parties) Act 1999.
- The Agreement and any non-contractual obligations arising out of or in connection with it will be governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
